Shri Subhash Yadav, Advocate Hon'ble Shri Justice Manindra Mohan Shrivastava Hon'ble Smt. Justice Rajani Dubey Order On Board 01/03/2019 Heard on (I.A.No.1) application for condonation of delay in filing appeal. Upon due consideration, delay is condoned.

Also heard on prayer for grant of leave to appeal. Learned counsel for the State would submit that the prosecution case is proved from the FIR lodged by the prosecutrix and the evidence on record. We have gone through the impugned judgment and evidence on record, particularly that of the prosecutrix.

Prosecutrix is a major. She has not supported the case of the prosecution. According to her, she had lodged a report with regard to the property dispute. She has not whispered any rape committed by the appellant and on suggestion given that any rape was committed on her, has also been emphatically denied.

In view of above, learned Trial Court has not committed any illegality or perversity in acquitting the respondents by giving him benefit of doubt. This petition is accordingly dismissed.
