The claim of the petitioners is that the petitioners were initially appointed as daily wager under the respondents, in due course of time, the petitioners were regularized in service in the year 2008. 2.

According to the petitioners, they have fulfilled the minimum eligibility criteria for promotion to the post of Assistant Grade-III from the quota reserved for promotion from class-IV to class-III.

The counsel for the petitioners submits that there are instances, where the persons who are juniors to the petitioners have been promoted on the post of Assistant Grade-III ignoring the claim of the petitioners. He further submits that there are sufficient number of vacancies available in the department, where the respondents can consider the claim of the petitioners.

4. Given the said facts and circumstances of the case, and also taking note of the fact that the representation in this regard filed by the petitioners is still pending consideration, the present writ petition at this stage stands disposed off with a direction to the respondents No.3 & 4 to consider and decide the representation of the petitioners at the earliest in accordance with rules and regulations.

5. The petitioners would also be at liberty to file a fresh representation, if they so desire, supported with all relevant documents.

6. Let the respondents No.3 & 4 take a decision within a period of 4 months from the date of receipt of the certified copy of this order.

7. It is made clear that this Court has not expressed any opinion on the merits of the case, so far as the entitlement of the petitioners is concerned.
