1. Heard.

2. The grievance of the petitioner is that the petitioner has been transferred from the office of Assistant Director, Horticulture, Baikunthpur District Koriya to the office of Assistant Director Horticulture, Balrampur, District Balrampur which is

around 170 KM.

3. It is stated that the husband of the petitioner is posted at Surajpur and the petitioner is having 17 months old infant and as per the clause 2.11 of the transfer policy normally the husband & wife are to be kept in the same place.

4. Perused the documents. Considering the fact that as per the Annexure P-2 the husband of the petitioner is posted at Surajpur, therefore, in view of the Clause 2.11 of the transfer policy, the petitioner is given liberty to make a detailed representation in this regard before the concerned respondent within a period of 15 days from today and on such representation being filed, the said respondent shall decide the same at the earliest preferably within a period of 45 days from the date of receipt of the representation. Till the representation of the petitioner is decided, the transfer order dated 23.08.2019 in respect of the petitioner shall not be given effect to.
