1. The present writ petition has been filed seeking a direction to the respondents No.1 & 2 to consider the claim of the petitioner for promotion from the post of field worker to the post of Lab Assistant. The contention of the petitioner is that the petitioner fulfills all the requisite eligibility criteria and seniority for promotion, but the respondents have not considered the case of the petitioner for reason best known. It is further the contention of the petitioner that he has made repeated representation to the authorities concerned but those representations also have not been yet decided.

2. Given the facts and the nature of the dispute raised, let respondent No.2 under whom the petitioner is working take a decision on the

representation which the petitioner has made, keeping in view the rules and regulations and the clarifications pertaining to the promotion so far as, the services of the petitioner is concerned.

3. Let this exercise be completed at the earliest preferably within a period of 90 days from the date of receipt of order of this Court. It shall be responsibility to the petitioners to apprise the respondent No.2 so far as, the order passed by this Court is concerned. It is further made clear that this Court has not expressed any opinion on the merits of the case so far as his entitlement is concerned.

4. With the aforesaid observation, this writ petition stands disposed off.
