Upon due consideration, I.A.No.01/2018 is allowed and delay in filling application for grant of leave to appeal is condoned.

We have heard learned counsel for the State on the prayer for grant of leave to appeal.

After going through the material on record, particularly

taking into consideration the testimony of child victim (PW/2), Sarita Banjari (PW/5) and Samal Kumar Kashyap (PW/6), we are inclined to grant leave to appeal.

Accordingly, the leave application is allowed. Let the appeal filed by the State be registered under the heading 'Acquittal Appeal' and the appeal be listed for further orders.
