HIGH COURT OF CHHATTISGARH, BILASPUR WPS No. 9452 of 2019 Smt. Khemlata Uike W/o Baliram Uike Aged About 41 Years Presently Working On The Post Of Supervisor In Integrated Child Development Service Project Keshkal, District Kondagaon Chhattisgarh R/o Village Bedma, Post Bahigaon, Police Station And Tehsil Keshkal, District Kondagaon, Chhattisgarh. ---- Petitioner

Versus

1. State Of Chhattisgarh Through The Secretary, Women And Child Development Department, Mantralaya Mahanadi Bhawan, Atal Nagar, Naya Raipur, District Raipur Chhattisgarh.

2. The District Program Officer Kondagaon, District Kondagoan, Chhattisgarh.

----Respondents For petitioner - Shri Surfaraj Khan, Advocate. For State- Shri Priyank Rathi, PL.

Hon'ble Shri Justice Goutam Bhaduri Order 20/11/2019 1.

The grievance of the petitioner is that the petitioner has been transferred vide order dated 8/11/2019 from Integrated Child Development Project, Keshkal, District Kondagaon to Integrated Child Development Project, Kondagaon-2, District Kondagaon which is 80 kms away. It is contended that transfer was made during the ban period and since the daughter of the petitioner is studying she may be transferred to a nearby place near Keshkal.

2.

Learned State counsel submits that hardly distance in between Keshkal to Kondagaon-2 is 30-35 kms or little more. 3.

Considering the fact the submission made and after perusal of the transfer order, I do not find any plausible reason to interfere as transfer is incidence of service, unless and until it is malafide or illegal normally interference in transfer is uncalled for. However, the petitioner is given liberty to make a representation before the Grievance Redressal

Committee. If such representation is filed, same may be decided as early as possible.

4.

With such observation, the petition stands disposed of. Sd/- (Goutam Bhaduri) JUDGE gouri
