1. The grievance of the petitioner is that the petitioner who is posted as Inspector at BSF is suffering from Kidnesy disease and he is being treated at Mata Vaishnav Devi Narayana Super speciality Hospital, Katra (Jammu) and PIG Chhandigarh. Learned counsel for the petitioner submits that on the medical ground, the petitioner requested to transfer to Katra and only two years are left for his superannuation. It is further submitted thereafter the petitioner was transferred to Gauhati instead of Katra and during the pendency of this petition, the respondents 2 & 3 were kind enough to communicate the petitioner about the cancellation of his transfer to Gauhati.

2. Learned counsel however requests that the petitioner may be given liberty to make a fresh representation to respondents 2 & 3 on the basis of medical documents showing his ailment and personal ground that only two years are left for his superannuation.

3. Considering the gesture shown by respondents 2 & 3 that they have already canceled transfer of the petitioner to Gauhati on medical ground, this writ petition is disposed of with a direction to the petitioner to make a representation to respondents 2 & 3 for his transfer to the native place for treatment on the basis of medical and personal ground within a period of 4 weeks from today and on such representation being filed, the same shall be considered and decided sympathetically as early as possible preferably within a further period of 4 months from the date of presentation of representation.
