Versus

1. State Of Chhattisgarh Through The Secretary, School Education Department, Mantralaya, Mahanadi Bhawan, New Raipur, District Raipur, Chhattisgarh.

2. Director, Directorate Of Public Instruction, Indravati Bhawan, New Raipur, District Raipur, Chhattisgarh.

3. Collector District Baloda Bazar-Bhatapara, Chhattisgarh.

4. District Education Officer, District Baloda Bazar-Bhatapara, Chhattisgarh

5. Block Education Officer, Simga, District Baloda Bazar-Bhatapara, Chhattisgarh.

----Respondents For petitioner - Shri Govind Dewangan, Advocate. For State- Smt. Deepti Shukla, PL.

Hon'ble Shri Justice Goutam Bhaduri Order 18/11/2019 1.

Grievance of the petitioner is that the petitioner working as teacher in Government Primary School, Adbandha, Block Simga has been transferred to Government Primary School, Bhothidih, Block Bhatapara by order dated 12/07/2019 on the administrative ground. It is contended that said transfer has been made during the ban period and order is back dated.

2.

Perused the transfer order. State counsel contends that maximum distance from Simga to Bhatapara is 35 to 40 kms or little more. Considering the fact that transfer in fact has no prejudicial impact and

transfer being incidence of service, I am not inclined to stay the transfer order. However, the petitioner is at liberty to make a representation within a period of 15 days from today to the concerned respondent. If such representation is filed, same may be decided within a further period of 45 days.

3.

With such observation, the petition stands disposed of. Sd/- (Goutam Bhaduri) JUDGE gouri
