The petitioner contends that the petitioner though have not been terminated but he has not been given work for last 4 1⁄2 months and the petitioner is working since 17/01/2016. It is stated that the petitioner was working as Data Entry Operator with respondent No.3, Chief Executive Officer, Janpad Panchayat Ramchandrapur, therefore in order to ascertain the status of the petitioner, the petitioner may be given liberty to make a representation.

Considering the fact that no order of termination exist concern of the petitioner cannot be sidelined. The petitioner claim that he has been appointed on 17/01/2016 and as per the law laid down in case of State of

Punjab & ors. Vs. Senior Vocational Staff Masters Association & Ors. (AIR 2017 SC 4072) no adverse order can be passed against a person without following the principles of natural justice. The petitioner is given liberty to make fresh representation before the respondents No.3 and 4 within a period of three weeks from today. Representation if so filed the respondents No.3 and 4 shall decide the same within a further period of 30 days from the date of receipt of representation. 3.
