Hon'ble Shri Justice Goutam Bhaduri Order 30.06.2020
1. Heard
2. Learned counsel for the petitioner would submit that the petitioner was transferred from Sector Mardapati Block Kanker to Sector Aamabeda Block Antagarh which was subject of challenge in WPS No. 8478/2019 wherein the petitioner was directed to file representation.
Thereafter, representation of the petitioner was rejected which was again subject of challenge. This Court by an order dated 28/11/2019 had stayed the transfer of the petitioner. It is contended that since the petitioner has been left with only eight months of his service, he has joined his place of transfer i.e. at Aamabeda as his salary was not being paid and he don't want to contest this case on the ground that his retiremental dues would be in question.
3. Considering the fact that the petitioner has already joined at his place of transfer i.e. at Aamabeda, therefore, no further adjudication would be required in this case. However, the petitioner is at liberty to make a suitable application before the concerned authority.
4. With such observation/ direction, the writ petition stands disposed off. Sd/-/- (Goutam Bhaduri) Judge Vishakha
