1. The petitioner has filed this writ petition stating inter alia that his application for grant of parole was not accepted by the Office of the District Magistrate, Durg.
2. This Court directed the learned State counsel to seek instructions and upon instructions, he submits that no such application was ever received by the Office of the District Magistrate, Durg and the petitioner was earlier granted the privilege of parole in the month of September, 2019 and if the petitioner submits application, his application will be considered in accordance with law, expeditiously.
3. The writ petition is disposed of with liberty to the petitioner to file application for grant of parole. If the application is filed by the petitioner today or tomorrow, that will be considered on the same day by the District Magistrate, Durg, in accordance with the rules and regulations.
If the petitioner files application before the Superintendent of Police (Jail), the Superintendent of Police shall
forward the same to the District Magistrate on the same day for consideration in accordance with law.
4. This order will be communicated by the State counsel to the learned District Magistrate as well as to the Superintendent of Police (Jail) today itself.
