On due consideration, delay of 141 days in filing the CRMP is condoned. Accordingly, IA No.1/2019 is allowed. 2.
The Trial Court has acquitted the accused of the charges under Sections 363, 366, 368, 376 (2) (Dha) and Section 16 read with Section 17 of the Protection of Children from Sexual Offences Act, 2012.

The prosecutrix was less than 18 years at the time of offence, but according to her statement, there was an affair with the accused
and she has made physical relation of her own sweet will. She also admits that after attaining the age of majority, she has married with the prosecutrix and further that on account of their relationship, she has given birth to a baby girl. 4.
In view of nature and quality of evidence on record, no case for grant of leave to appeal is made out.

Accordingly, the CRMP is dismissed.
