Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 21/01/2019 :

1. The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. Nil (Complaint Case No.525/10, which is pending before the Judicial Magistrate 1st Class, Bilaspur for offence under Section 420 of the IPC.

2. The applicant was earlier released on bail vide order dated 7.9.2011 passed in MCrC No.1839/2011, however, on account of his absence before the trial Court, he has again been arrested on 14.11.2018.

3. Considering the fact that since after his re-arrest, the applicant is in jail since last more than 2 months and also considering other relevant aspects of the matter, this Court is inclined to release the applicant on bail.

4. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond in sum of Rs.50,000/- with one surety in the like sum to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
