This is the Second Bail application under Section 439 of the CrPC. 2.

The applicant has been arrested in connection with Crime No.111/2018 registered in Police Station Nagarda, District Janjgir-Champa (C.G.) for the offence punishable under Section 34(2) of CG Excise Act. 3.

Earlier bail application was dismissed as withdrawn on 28/11/2018 in MCRC No. 9163/2018.

Case of the prosecution, in brief is that on 18/10/2018, 5.400 bulk liters of country made liquor has been seized from the possession of the applicant. 5.

Counsel for the State submits that four other criminal case have been registered against the applicant out of which three under Excise Act and one under CrPC.

Counsel for the applicant further submitted that the applicant is in jail since three months and charge-sheet has been filed, thus he may be released on bail.

Looking to the above facts and circumstances of the case, looking to this fact that four other criminal cases have been registered against the applicant, this Court is not inclined to give the benefit to the applicant. Accordingly, bail application is dismissed.
