1. Learned counsel for the petitioner submits that the petitioner was transferred from Government Higher Secondary School Sukma, District Sukma to Block Education Officer, Sukma, District Sukma, thereafter, when he went to take charge as Block Education Officer, Sukma he has not been given charge instead a person junior to petitioner i.e. Lecturer, Respondent No. 4 has

been given charge, therefore, the petitioner has to work under Respondent No. 4, who is a junior. It is contended that the procedure cannot be adopted and the petitioner being senior and as he has been transferred to a substantive post, therefore, he has made a representation (Annexure P-4). The Collector may be directed to decide the same.

2. Considering the grievance of the petitioner, prima facie, it appears that the petitioner has been transferred as Block Education Officer, Sukma thus the petitioner is given liberty to file a fresh representation for handing over charge to Respondent No. 2 within two weeks from today. The same if filled shall be decided by Respondent No. 2 within a further period of 30 days from the date of receipt of copy of this order.
