Hon'ble Shri Justice P. Sam Koshy Order on Board 12.12.2018

1. The claim of the petitioner is for a direction to the respondents for grant of compassionate appointment. The husband of the petitioner died in harness on 17.12.2011, thereafter the petitioner had filed an application for compassionate appointment on 09.04.2012, till date the respondents have not taken a decision on the said application and the same is still pending consideration.

2. Given this specific averment by the petitioner this Court is of the opinion that no fruitful purpose would be served in keeping the petition pending, rather ends of justice would be served if the writ petition is disposed off with a direction to the respondents No.2 & 3 to consider the claim of the petitioner for compassionate appointment, which is pending consideration before the authorities since 2012 onwards.

3. Let this exercise be completed within a period of 90 days. It is made that respondents shall consider the case of the petitioner in accordance with the policy of the State Government so far as, grant of compassionate appointment is concerned. Needless to mention that directive given by this Court in this writ petition would be necessary only in the event if the application of the petitioner has not yet been decided. Sd /- (P.
