Learned counsel for the petitioners would submit that the petitioners intend to take the civil remedy of seeking declaration of legal status and this application for modification has been preferred by way of abundant caution so that the order passed by this Court may not come in the way of seeking declaratory relief. 2.
This Court gave liberty to the petitioners to apply for succession certificate
-2before the competent authority. The petitioners remedy to seek declaration of his legal status by filing a suit before the Civil Court of jurisdiction is not in any manner restricted by the order passed by this Court. 3.
