Shri Soumya Rai, PL Hon'ble Shri Justice Goutam Bhaduri Order On Board 17/12/2019
1. Heard.
2. The only grievance of the petitioner is that the petitioner opted for voluntary retirement on 12.10.2017. Earlier to it in respect of the promotion, the name of the petitioner was inadvertently left out from the gradation list. Consequently, he was not given the selection and senior grade. Subsequently, his name was included.
3. Learned counsel for the petitioner would submit that thereafter the petitioner
has made several representations to the respondent No.2, however, the same is not been decided as the petitioner is entitled for selection and senior grade.
4. Considering the limited prayer made by the petitioner with reference to the Annexure P-9, which is the representation appears to have been filed by the petitioner for grant of senior grade and selection grade, since it has been stated that petitioner's name was subsequently included and it was earlier left out in the gradation list. If it is so, petitioner's representation requires to be considered and he is entitled to the similar benefit which has been given to the other juniors. Therefore, it is directed that the representation of the petitioner which is pending at the end of the respondents shall be decided within a period of 90 days from the date of receipt of this order taking into the fact which have surfaced and including the documents filed along with the representation.
5. With the aforesaid observation, the writ petition stands disposed of. Sd/- Goutam Bhaduri Judge Ashu
