1. The present Contempt Petition has been filed alleging noncompliance of the Order passed by this Court on 29.08.2018 in WPS No. 5568 of 2018.
2. The respondent has filed reply on 12.09.2019 and along with their reply, they have produced records of the original review DPC that was held on 06.09.2019 enclosed as Annexure R-3.
3. In the review DPC, they have considered the case of the petitioner/applicant and also have found him suitable for promotion but for want of vacancy, the petitioner/applicant could not be promoted.
-24. Given the said fact that, the review DPC has been held in which the petitioner's case was considered. This Court is of the view that the substantial compliance of the directive given by this Court stands complied with. In case, if the petitioner/applicant is still aggrieved of the outcome of the review DPC, the same could be questioned only by way of fresh proceedings which cannot be tested under the contempt jurisdiction of this Court.
