For State :

Shri Dhiraj Wankhede, GA Hon'ble Shri Justice P. Sam Koshy Order on Board 12/12/2018 1.

The present writ petition has been filed primarily on the grievance of the petitioner that though the petitioner is senior person in the department working as a Principal of the Government Higher Secondary School, Kandel, District Dhamtari, the charge of the District Education Officer lying vacant in the department is being handed over to the person much junior to the petitioner and in the process he has made respondent No. 4 to 8 as

respondent who are much junior to the petitioner but have been made incharge District Education Officer at different Districts. 2.

The petitioner has filed the writ petition with a request to give a direction to the respondents to consider the case of the petitioner also for being given the charge of the District Eduction Officer considering his seniority, keeping in view the circular of the State Government dated 04/08/2011. 3.

Without commenting anything on the merits of the case so far as the entitlement of the petitioner is concerned, this Court is of the opinion that ends of justice would meet if the writ petition itself could be disposed off with a direction to the respondent No. 1 to consider the grievance of the petitioner in the light of the circular of the State Government dated 04/08/2011.

4.

Perusal of the records reveals that the petitioner has not till date made any representation in this regard. Thus the petitioner is therefore directed to file a detailed representation supported with all relevant records to the respondent No. 1 within a period of three weeks from today and the respondent No. 1 in turn is expected to take a decision on the said representation as expeditiously as possible preferably within a period of three months from the date of receipt of the representation to be made by the petitioner.
