Learned counsel for the petitioner would submit that in course of hearing on 29.02.2016, a statement was made that the petitioner's writ petition along with other connected matters had become infructuous, however, the petitioner's petition was not infructuous, but such statement was made due to inadvertence, because several matters were clubbed together. 2.

Considering the explanation offered by the learned counsel for the petitioner, the order dated 29.02.2016 in respect of WPS

No.5587/2011 is recalled and the said writ petition is restored to its original number.
