Hon'ble Shri Justice P. Sam Koshy Order on Board 13/12/2018 The challenge in the present writ petition is to the order of suspension dated 31.10.2018 whereby the services of the petitioner have been placed under suspension.

Perusal of the record would reveal that the petitioner has been placed under suspension invoking Rule 9 of the Chhattisgarh Civil Services (Classification, Control and Appeal) Rules, 1966. The order under Rule 9 is an appeallable order under Rule 23 of the Rules, 1966.

In view of the fact that there is a provision for appeal available under the Rules, this Court is not inclined to entertain the writ petition at this juncture. Reserving the right of the petitioner to prefer an appeal to the appellate authority, the present writ petition in its present form stands dismissed as not maintainable.
