Earlier while passing the order in 3rd bail application of the applicant Ashish Patnayak bearing MCRC No. 2247/2019 dated 13-5-2019, this Court directed the trial Court to dispose of the matter as soon as possible preferably within 3 months from the date of receipt of copy of the order. Thereafter while passing order in 4th bail application of the applicant Ashish Patnayak bearing MCRC NO. 5779/2019 dated 5-11-2019, this Court called a report from the concerned trial Court as to whether he has applied for extension of time or not because till that day, the trial was not concluded and no application was brought to the knowledge of this Court that the concerned trial Court had applied for extension of time.

As per letter of request, the Special Judge, NDPS Act, Bilaspur has prayed for further time to conclude the trial. He further submitted that he tender apology for delay in seeking extension of time occurred inadvertently as the letter of request could not be prepared in time.

4. The concerned trial Court is directed to dispose of the case as soon as possible preferably within a period of 45 days from the date of receipt of a copy of this order.

5. The Presiding Officer Shri Sanjeev Kumar Tamak is expected to be vigilant and careful in future in complying with the order of High Court. It is also expected from him to seek extension of

time in such matters, if required, before expiry of the prescribed time limit.

6. Copy of this order be sent to the concerned Distt. and Sessions Judge and to the concerned Presiding Officer.
