2. The grievance of the petitioner is that the petitioner has been transferred from the office of Integrated Child Development Service Project, Rajpur, District Balrampur-Ramanujganj to the office of Integrated Child Development Service Project, Bhaiyathan, District Surajpur.

3. It is contended that the wife of the petitioner is working at Rajpur and since the petitioner has been transferred from one Tribal area to another tribal area which is against the transfer policy dated 03.06.2015 because as per the clause 2.2 of

the transfer policy a person should not be transferred from one tribal area to another tribal area when unless and until there is a departmental enquiry or complaint made against him, therefore, the transfer of the petitioner from Rajpur, District Balrampur-Ramanujganj to Bhaiyathan, District Surajpur, which is also a tribal area, without the wish of the petitioner cannot be made.

4. I have heard learned counsel for the petitioner and perused the contents of the transfer policy and clause 2.2 thereof. Considering the same, it is directed that the petitioner shall make afresh representation in this regard within a period of 15 days from today before the grievance redressal committee and the committee in turn shall consider and decide the same in accordance with the transfer policy at the earliest preferably within a further period of 60 days. Till the representation of the petitioner is decided, the transfer of the petitioner shall not be given effect to.

5. With the aforesaid observation, the writ petition stands disposed of. Sd/- Goutam Bhaduri Judge Ashu
