The case was listed on 22.11.2019 and the State was directed to file reply, thereafter, when the case was listed on 17.12.2019 it was adjourned and again the case come up for hearing today but the instructions of the State are still awaited.

The case of the petitioner is that by order dated 13.08.2019 the petitioner was transferred from Mohla, District Durg to the Office of Collector, Land Record, District Bilaspur. Subsequently, he joined at Bilaspur on 29.08.2019. Thereafter, the petitioner was placed at Tahsil Masturi by order dated 13.09.2019 (Annexure P-4) and subsequently it was amended on 16.09.2019 (Annexure P-5) whereby the posting of the petitioner was made at Tahsil Marwahi.

Again on 30.09.2019 (Annexure P-6) the petitioner was transferred from Tahsil Marwahi to Land Record Bilaspur and lastly by order dated 06.11.2019 (Annexure P-7), it is stated that the petitioner has been transferred from the Collectorate Land Record Bilaspur to the Collectorate Land Record Mungeli.

Learned counsel for the petitioner submits that it is the frequent transfer which has been made. The petitioner has been transferred to different places within a short span of time and lastly the petitioner was posted at Land Record Bilaspur and has been again transferred to Collectorate Land Record Mungeli. 4.

No reply has been filed till date, despite the time was granted to the State from time to time. Considering the fact, it is directed that the petitioner shall be at liberty to make a representation within 15 days to the respondent No.2, Commissioner, Bilaspur Division, canvassing all his grievance. If such representation is made, the same shall be decided within a period of 45 days from the date of receipt of the representation. In the meanwhile, if the transfer of the petitioner has not been given effect to, the same shall remain stayed till the representation is decided.
