Taking into consideration the ground for condonation of delay and the total period of delay of 14 days only, we are inclined to condone the delay.

Taking into consideration the submission of learned State counsel that despite prosecution having led more than one eye witnesses, they have been disbelieved on minor and immaterial discrepancies and acquitted of charges of murder, we are inclined to grant leave to appeal. Accordingly, application is allowed.

Let the appeal filed by the State be registered as Acquittal Appeal and be listed for further orders.
