The present CrMP has been filed seeking restoration of an earlier CrMP which got dismissed by virtue of peremptory order passed by this Court on 24.06.2016.

From the record it is clear that the present CrMP has been filed more than 2 1⁄2 years after the order was passed in the earlier CrMP. Moreover, this Court finds it difficult so far as the maintainability of the present CrMP seeking restoration of an earlier CrMP is concerned. In the opinion of this Court, nothing precludes the petitioner filing a fresh CrMP for redressal of

his grievance as the earlier CrMP got dismissed only on account of a peremptory order and not on merits.

Accordingly, the present CrMP stands dismissed as not maintainable. Sd/- (P. Sam Koshy) JUDGE Khatai
