2. Counsel for the applicant does not want to press I.A. No.1/2019 application for condonation of delay in filing the application for restoration.

3. Consequently I.A. No. 1/2019 is dismissed without considering merits of the case.

4. Earlier on 14/06/2012 W.P.(S) No.38/2005 was dismissed for want of prosecution.

5. Looking to the facts and circumstances of the case, looking to the reason stated in para No. 2 of the said application this Court is

satisfied that when the said writ petition was called for hearing on 14/06/2012 counsel for the petitioner did not appear due to just and sufficient ground.

6. Consequently application for restoration is allowed and aforesaid writ petition is restored to its original number subject to condition that applicant shall pay Rs. 2000/- in the account of High Court Bar Association for Library purpose.

7. Matter disposed of accordingly.
