Hon'ble Shri Justice P. Sam Koshy Order on Board 13/12/2018 The challenge in the present writ petition is to the order Annexure P1 dated 28.11.2018 whereby the services of the petitioner have been placed under suspension.

Primarily the challenge is on the competency of the Officer who has placed the petitioner under suspension.

Given the facts and circumstances of the case which reflects from the order of suspension, this Court is not inclined to entertain the writ petition at this juncture.

However, the petitioner would be at liberty to either file a representation before the same authority or prefer an appeal before the higher authority ventilating his grievances. Subject to the petitioner preferring a representation or an appeal before the concerned authority as the case may be, within a period of 7 days from today, the authority concerned shall take a decision on the said representation or appeal within a further period of 30 days thereafter. While passing the order, the authority would take note of the grounds and contentions which the petitioner raises in his representation/appeal. 5.

With the aforesaid observation, the writ petition stands disposed of. Certified copy today.
