1. The instant writ petition is filed making a prayer for extension of appointment to the post of Project Officer wherein the petitioner was initially appointed. It is contended that the service of other similarly placed persons namely Suresh Singh Tomar and others who cases are identically placed were extended, therefore, the case of the present petitioner may also be considered on similar footing. Consequently, at this moment, limited prayer is made that the representation which has been filed by the petitioner for extension of service may be considered.
2. Learned State Counsel was directed to seek instructions in respect of the
said submission made by the petitioner. He submits that the representation of the petitioner shall be decided.
3. Accordingly, the present writ petition is disposed of with a direction that respondents no.2 & 3 shall take a decision on the representation of the petitioner within a period of 45 days from the date of receipt of certified copy of this order and while deciding the representation, the authorities concerned shall also take into consideration the contention raised by the petitioner in his representation.
4. It is needless to mention that in case the service of the Petitioner has not been discontinued, he would be permitted to be continued till the decision is taken by Respondent No.2.
