The challenge in the present writ petition is to the award passed by the labour Court, Rajnandgaon in case No. 7/I.D. Act/Reference/2011. The labour Court has rejected the claim for reinstatement by the petitioner and have answered the reference in the negative. This Court is not inclined to entertain the writ petition only on the ground of delay and latches. The award under challenge is one which was passed more than six years ago that is on 31.10.2012 and the present writ petition has been filed as late as on 9.12.2018 that is more than after six years of time.

Perusal of the record would also reveal that even while raising disputes before the labour Court there was an inordinate delay on the part of the petitioner in as much as he had been discontinued from service on 4.2.2000 and he had challenged the discontinuation only in the year 2011 that is after about eleven years time.

With the aforesaid reasons itself, this Court is not inclined to entertain the writ petition and the same thus suffering from delay and latches stands dismissed. Sd/- (P. Sam Koshy) Rohit JUDGE
