The challenge in the present Writ Petition is to the order Annexure-P/1 dated 29/09/2018 whereby the services of the petitioner has been terminated by the department without conducting any departmental enquiry and it is alleged that the same is in violation of the provisions of the service rules governing the field.

During the course of hearing it is reveal that against the said order of termination, the petitioner has already raised the dispute under Section 55(2) of the Chhattisgarh Cooperative Society Act, 1960 before the respondent No.2 and the matter is pending consideration before the said authority, but

according to the petitioner, no substantial development has taken place on the said proceedings.

The counsel for the respondent No.2 submits that, the authorities has since proceeded with the matter and the next date has been fixed on 04/01/2019.

In the given facts of the petitioner having already availed the alternative statutory remedy under Section 55(2) this Court is of the opinion that ends of justice would meet if the Writ Petition is disposed off with a direction that the authorities concerned shall proceed and decide the matter as expeditiously as possible preferably within a period of 4 months from the next date of hearing fixed by the authorities.
