The limited prayer which the petitioner makes is that though the petitioner was initially found suitable for promotion. Promotion order was also issued on 12/8/2010 but because of prolonged litigation initiated by some third party, promotion orders could not be given effect to and those ligitations have ultimately culminated in the dismissal of the writ petition. Thereafter the petitioner was entitled for promotion but the respondents for reasons best known have not extended the benefit to the petitioner. The petitioner has been repeatedly approaching the authorities for redressal of his grievance by implementing the promotion orders, so far as the petitioner is concerned, whereas, the other similarly placed persons have already been granted this benefit.

Given the limited grievance which the petitioner has raised this Court is of the opinion that no fruitful purpose would be served in keeping this petition pending rather ends of justice would serve , if the petition is disposed off with

direction to the respondents No. 2 & 3 to immediately consider the representation of the petitioner and to pass appropriate order within a period of 60 days from the date of receipt of copy of this order. The respondent authorities while deciding the case shall keep in mind the fact that the petition reason on account of which the petitioner was not granted benefit of the promotion order, does not survive any further and similarly placed persons have already got benefits arising out of the same promotion order. 3.
