This is second application filed under Section 438 of the Cr.P.C. before this Court as the applicant is apprehending arrest in connection with Crime No.363/2018 registered at Police Station Civil Line, Bilaspur, District Bilaspur (C.G.) for the offence punishable under Section 354, 454, 506 of the IPC and Section 8 of Protection of Children from Sexual Offences Act. 2.

This repeat application for grant of anticipatory bail has been brought only on the circumstance that the parties have entered into compromise. The earlier application, MCRCA No.88 of 2019 was rejected on merits on 05-022019. 3.

The factum of compromise if any cannot be noticed by this Court. The applicant may surrender before the concerned Court and make a prayer for grant of bail on the basis of the compromise. Therefore, this repeat application is dismissed at the motion stage. However, it is directed that if the applicant surrenders before the concerned Court within a period of one week from today and makes a prayer for grant of regular bail, that may be considered and decided by the said Court preferably on the same day.
