1. Heard.

2. By way of the present petition, the petitioner has challenged the order dated 21.08.2019 whereby the petitioner has been transferred from Government Nehru Post Graduate College, Dongargarh, District Rajnandgaon to Government Girls College, Jagdalpur, District - Bastar (C.G.).

3. It is contended that the petitioner was appointed on the post of Sports Officer in Government College Ambagarh Chowki in the year 1998. Thereafter, the petitioner was transferred from Government College Ambagarh Chowki to Government Nehru Post Graduate College, Dongargarh in the year 2000. Again in the year 2008 the petitioner was transferred from Government Nehru Post Graduate College, Dongargarh to Government Danteshwari Girls College

Jagdalpur. Thereafter, in the year 2009 he was transferred from Government Danteshwari Girls College, Jagdalpur to Government Nehru Post Graduate College, Dongargarh. Now by the impugned order the petitioner has been transferred from Government Nehru Post Graduate College, Dongargarh, District Rajnandgaon to Government Girls College, Jagdalpur, District - Bastar (C.G.).

It is stated that the transfer of the petitioner has been made against the clause 1.3 of the transfer policy and the petitioner has spent 3 years in the scheduled area and there would be a practical problem with the petitioner as he is posted in the girls college as a sports teacher, therefore, the transfer of the petitioner may be canceled.

5. I have heard learned counsel for the petitioner and perused the documents.

6. Considering the facts of this case, I do not find any reason to interfere with the transfer order dated 21.08.2019 as 3 & 1⁄2 months have passed. However, the petitioner is given liberty to make a suitable afresh representation to the Grievance Redressal Committee within a period of 15 days from today and on such representation being filed, the Committee in turn shall decide the same as early as possible preferably within a period of 45 days from the date of receipt of the representation.
