The present is a second round of litigation in respect of monetary benefits which the petitioners is entitled for second time scale pay. 2.

The brief facts of the case is that the petitioner wherein earlier occasion had filed along with other petitioners filed in WPS No. 532/2016 for grant of benefit of second pay scale the said writ petition got disposed off in the light of the order passed in the case of Rammani Tripathi Vs. State of Chhattisgarh & others, passed in WPS No. 6698/2014 decided on 24/12/2014. Directions given to the respondents to consider the case of the petitioners for grant of similar relief to take appropriate decision. The grievance now of the petitioner is that pursuant to the aforesaid order by this Court the authorities have been scrutinising the claim of the petitioners and they have also formerly taken the decision that the petitioners are entitled for the same but so far as the quantification of the dues are

concerned, correspondence are being made by the officers at different levels and that more than 3 years have passed the petitioner till date have not got benefit arising out of the same. He refers to the certain documents which have been issued by the department wherein it reflects that in the case of similarly placed persons the process of verification for extending all the said benefit has already been started.

Given the factual matrix of the case this Court is of the opinion that no fruitful purpose would be served in keeping the writ petition pending rather ends of justice would meet if the writ petition is disposed of with direction to respondent No. 2 & 4 to finalize the claim of the petitioner at the earliest preferably within a period of 3 months from today. In case if it is found that the petitioner is entitled for the benefits as has been claimed the same should also be released forthwith.
