Shri Sudip Agrawal, Advocate for respondents No.1&2. Shri Raj Kumar Gupta, Advocate for respondent No.3. Alleging non compliance of the order dated 02.07.2019 passed by this court in WPS No.4823 of 2019, the present contempt petition has been filed.

Shri Raj Kumar Gupta enters appearance on behalf of respondent No.3 and has filed his reply. He has also enclosed a document Annexure R/6, dated 03.01.2020 and has shown that GPF amount of the petitioner has been ordered to be released to the petitioner to the tune of Rs.2,52,121/-. In addition, interest also for an amount of Rs.70,090/- has been sanctioned to be paid to the petitioner.

The counsel for the respondents No.1&2 submits that the department had offered a cheque amounting to Rs.3,22,210/- to the petitioner which she has refused to accept.

Given the said submissions made by the counsel for the respondents, so also perusal of records including reply filed by the respondents, this court is of the opinion that the order dated 02.07.2019 passed in WPS No.4823 of 2019 stands duly complied with.

Let the petitioner accept the cheque which has been prepared by the respondents. If the department is having the Bank Account Number of the petitioner, let the department take steps in getting the

amount deposited in the Bank Account of the petitioner. As regards the quantum of amount released by the respondents is concerned, it shall be open for the petitioner to approach the concerned authorities showing actual calculation, which according to her was payable to the petitioner, and the department, in turn, shall consider the said facts by scrutinizing the same in accordance with law and redress the grievance in accordance with rules governing the fields.

In case, if the petitioner still has grievance, it shall be open for the petitioner to approach this court by way of a fresh writ petition. The quantum of amount or a dispute in respect of the quantum of amount paid by the respondents cannot be decided exercising contempt jurisdiction of this court.

The contempt petition accordingly stands disposed of with the aforesaid observations.
