This is the first bail application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested in connection with Crime No.273/2019, registered at Police Station Utai, District Durg(CG) for the offence punishable under Sections 419, 420, 467, 468, 471, 120-B of the IPC.

As per the case of prosecution, the complainant lodged a report that forged and fabricated caste and domicile certificates have been produced by 32 persons at the time of recruitment to the post of Constable in CISF.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the crime in question and he is a student pursing his studies. She submits that charge sheet has been filed. She further submits that the other co-accused
persons have already been enlarged on bail by this Court in MCRC No.6444/209 and other connected matters (MCRC Nos.6506/2019,6530/2019, 6531/2019, 6597/2019). She submits that the applicant is in jail since 15.8.2019 and trial may take some time for its final disposal therefore, the applicant may be released on bail.

On the other hand, learned counsel for the State opposes the bail application.

Perused the entire material available on record. 7.
Considering the facts and circumstances of the case, in particular the nature of allegations and the detention period of the applicant and the similarly placed persons have already been enlarged on bail, I am of the opinion that present is a fit case to release the applicant on bail.

Accordingly, the bail application filed under Section 439 Cr.P.C. is allowed.

It is directed that the applicant shall be released on bail on his furnishing a personal bond in sum of Rs.25,000/- with one surety in like sum to the satisfaction of the concerned trial Court for his appearance before the said Court as and when directed till the disposal of the trial.
