Hon'ble Shri Justice Goutam Bhaduri Order on Board 06.12.2019
1. Grievance of the petitioner is that the petitioner working as Assistant Grade-III has been transferred from District Treasury, Bilaspur to District Treasury Kanker by order dated 13.08.2019.
2. It is contended that the petitioner is office bearer of the Union holding the post of Secretary, therefore, he would be under the protected category and he cannot be transferred as per the policy of the State.
3. State counsel opposes the argument and would submit that as per Annexure P-4, one Pradeep Sharma has been shown as Secretary whereas this petitioner is also shown as Secretary. It is not clear whether he was elected or not ? Considering the fact, since it is stated that the
petitioner has already made a representation before the Grievance Redressal Committee on 20.08.2019 (Annexure P-8), the same shall be decided within a period of 60 days from the date of receipt of a copy of this order.
4. Since the order was passed on 30.08.2019 in respect of transfer, I do not find any force, at this stage, after four months, to stay the effect and operation of the order.
5. With such observation, the writ petition stands disposed of. Sd/- (Goutam Bhaduri) Judge Ashok
