1. The present is a second round of litigation. Earlier bail application stood dismissed as withdrawn with liberty to revive after the prosecutrix is examined. Subsequent to that the present bail application has been filed by the applicant on the ground that the prosecutrix has not been sighted as a witness by the prosecution and the relatives of the prosecutrix who have been examined have not supported the case of the prosecution.

2. On the previous date the State counsel had taken time to seek instruction. Today on instruction, learned State counsel submits that on 16/01/2019 an application has already been submitted before the Trial Court seeking permission to call upon the prosecutrix as a witness which has since been allowed, the case now fixed for the evidence of the prosecution on 24/01/2019.

3. Given the said facts now that the prosecutrix has been sighted as a witness and the case now proceeds for the further evidence, present

bail application stands disposed off at this stage. Reserving the right of the petitioner to revive the bail application after the prosecutrix is examined.
