30/09/2019 1) In Writ Appeal No. 185/2018 decided on 25/07/2018 it was directed that the respondents shall conclude the pending Departmental Enquiry against the applicant within 4 months, failing which the charge-sheet and the additional charge-sheet would be deemed to be quashed. It was further directed that Gratuity and other post retiral benefits will all accrue in favour of the applicant after the time frame fixed by the Court expires or the Departmental Enquiry is concluded. No other order in respect of any consequential benefit was passed in the writ appeal.

2) In view of the above, if after deemed quashment of the Department Enquiry the respondents have decided to make payment of the subsistence allowance during the period of suspension, the same may not amount to commission of

contempt of our order. We have not dealt with any payment for which the applicant may be entitled for a period prior to his retirement.
