The present petition is to quash the FIR dated 30.08.2018 whereby the offence under Section 354, 354(A) & 506 of I.P.C. and Section 18 of the POCSO Act has been registered. 2.

It is stated that subsequently an enquiry was carried out by the police and the investigation officer by a letter dated 01.10.2018 has stated that after investigation, he found that no offence is made out as per the letter attached with this petition, therefore, the FIR may be quashed.

Perused the contents of the letter dated 01.10.2018 written by the S.D.O.P., Premnagar, District Surajpur to the Superintendent of Police, District Surajpur. The letter purports that on enquiry, the investigation officer found that no offence is made out. Under the circumstances, if the contents of the letter are correct and it is a

real communication made by the I.O. to the S.P. then accordingly the finding may be recorded in the investigation. 4.
