1. The grievance of the petitioner is that the petitioner is working as Supervisor and has been transferred from Integrated Child Development Project, Dharsiva-2 District Raipur to Integrated Child Development Project, Saraipali, District Mahasamund.

2. It is stated that the petitioner is on maternity leave from April, 2019 and she has given birth to a child. It is further contended that petitioner's husband is also working at Raipur and the petitioner was transferred on the ground that the husband and wife are to be kept at same place and both were posted at

Raipur. It is further contended that petitioner's husband is 40 % disabled and according to the policy husband and wife are to be kept at same place therefore the transfer of the petitioner may be cancelled.

3. Perused the documents.

Perusal of the documents, prima facie shows that the petitioner was on maternity leave and considering this fact and taking into the document Annexure P-6 disability certificate of petitioner's husband and further taking into the fact that the petitioner's husband is also working at Raipur. The petitioner is given liberty to file a representation before the Grievance Redressal Committee within 15 days from today. The same if filed shall be decided within 45 days from the date of receipt of a copy of this order. The transfer of the petitioner if not given effect to shall be stayed till the representation is decided.
