1. Heard.

2. Defendant's application to cross-examine the plaintiff and his witnesses to lead evidence is closed on account of non payment of cost of Rs.1,000/-.

3. Taking into consideration the submission made by learned counsel for the petitioner that he had no funds to make payment the said cost on that particular date and he is ready to make payment of the cost now, the impugned order is set aside subject to payment of cost of Rs.1,000/- on the next date of hearing i.e, tomorrow.

4. If he makes payment of the cost by tomorrow he will be allowed to cross-examine the plaintiff and his witnesses and also allowed to lead evidence. Plaintiff will be entitled to make application for modification if he feels dis-aggrieved with the order.

5. A copy of this order be sent to the concerned trial Court directly and through Email and Fax.

6. C.C. Today.
