1. On due consideration delay of 35 days in filing of the Cr.M.P. is condoned. Accordingly, I.A. No.01/2019, application for condonation of delay in filing of the Cr.M.P. is allowed.

2. Learned trial Court has acquitted the accused of the charge under Section 302 of the I.P.C.

3. Having perused the statement of eye-witness PW-9 Prashant Singh Khutel, son of deceased - Alkhuram Khutel,

CRMP No. 2667 of 2019 we are inclined to grant leave to appeal against acquittal.

4. Accordingly, Cr.M.P. deserves to be and is allowed.

5. Let regular acquittal appeal be registered and the same be posted for consideration in the next week.
