1. Grievance of the petitioner is that the petitioner was working as Superintendent : Kasturba Gandhi Avasiya Vidyalaya Pahariya, District Janjgir-Champa wherein on certain complaint, an exparte enquiry was conducted and finding was recorded and against such enquiry, the petitioner made a representation to give her opportunity of hearing. Consequent thereto, the opportunity of hearing was acceded by the Managing Director by Annexure P-1; however, in the meanwhile on the basis of the earlier finding of enquiry, the services of the petitioner has been repatriated to Government High School Kirari, Block Akaltara.

2. It is stated that since the initial repatriation certain observation was made on the basis of earlier finding of the enquiry, the representation at present made by the petitioner may be decided.

3. Without any observation on merit, at this stage, since the petitioner only claims that the representation may be decided, the respondent No.3, Collector, shall decide the representation of the petitioner within a period of 45 days from the date of receipt of a copy of this order.

4. With such observation, the writ petition stands disposed of. However, this Court has not made any observation on the merit of this case. Sd/- (Goutam Bhaduri) Judge Ashok
