This petition has been brought praying for issuance of direction for speedy disposal of the case No.368 of 2019, pending before the Court of Principal Judge, Family Court, Raipur (C.G.). 2.

The petitioner and the respondent have jointly filed an application for grant of decree of divorce under Section 13 (b) of the Hindu Marriage Act on 15.03.2019. According to the copies of the order sheets filed along with the petition, the learned Family Court has mentioned in the last order sheet dated 29.08.2019 that the waiting period is still not expired.

As there is specific provision of cooling period of six months to be given before deciding the application under Section 13 (b) of the Hindu

Page No.2 Marriage Act, therefore, this provision can not be ignored or jumped for deciding such application. However, the petition is disposed off and the learned Family Court is directed to decide the application of the parties as soon as possible because now the cooling period has expired. 4.

Accordingly, the petition is disposed off.
