1. Grievance of the petitioner is that the petitioner joined to the post of Chief Municipal Officer, Grade-B, on 05.10.1982. Subsequently, he was promoted to the post of Chief Municipal Officer, Grade-A on 18.06.1992 and thereafter eventually he was retired on 31.07.2017. It is contended that the petitioner though had total service period of 35 years 9 months, however, only for one time, the petitioner was granted the benefit of promotion and no kramonnati / third higher pay scale was granted to him for which he is entitled, as he has already completed 30 years of service before 01.01.2016. Therefore, prayer was made to the Secretary, State of Chhattisgarh, that he may be granted third higher pay scale from 01.01.2016.

2. Learned counsel for the petitioner would submit that the said representation having been made, the same has been forwarded by the

Director, Department of Urban Administration for adjudication to the State, however, the same has not been decided till date. Therefore, the State may be directed to decide the entitlement/ claim of the petitioner for third higher pay scale within the stipulated time.

3. Considering the fact that the petitioner has already rendered more than 30 years of service and the petitioner has already made a representation to the State, which is under consideration, it is directed that the petitioner shall be at liberty to make a fresh representation to the respondent No.1 within a period of three weeks projecting entire detail and if such representation is filed, the same shall be considered and decided by the respondent No.1 within a further period of 6 months from the date of receipt of the representation.
