Taking into consideration the submission of learned State counsel that even though the evidence has been led by the prosecution to prove that the respondent had bitterly beaten his wife all through over the night and later on, she was set ablaze, we are inclined to grant leave to appeal. Therefore, the application for grant of leave to appeal is allowed. 2.

The appeal filed by the State be registered as an acquittal appeal and be listed for further orders.
