Hon'ble Shri Justice Manindra Mohan Shrivastava Hon'ble Smt. Justice Vimla Singh Kapoor, Order on Board by Justice Manindra Mohan Shrivastava, J. 08.02.2021 Heard on prayer for condonation of delay in filing appeal as also prayer for grant of leave to appeal.

Even if we are inclined to condone the delay, on the face of the evidence of the prosecutrix herself (PW-10), the order of acquittal does not appear to be perverse or suffering from any patent illegality, inasmuch as, the prosecutrix herself has not supported the prosecution and turned completely hostile. Therefore, there is no merit in this petition.

Application is accordingly, rejected.
